Fines and driver's licenses
How much does it cost to appeal a traffic fine?
Filing objections or an appeal has no administrative fee: appealing in itself costs nothing. What does have a price is the decision, because if you pay within the first 20 calendar days you pay only 50%, and by doing so you give up your right to appeal. If you appeal and the decision doesn't go your way, you'll pay 100%. Our fees depend on the type of penalty and whether points are deducted from your license: we tell you before we start, at the first consultation.
How long do I have to appeal a fine?
Twenty calendar days from when you receive the notice to file objections. If the decision goes against you, you have one month from when you're notified of it to file an appeal for reconsideration (recurso de reposición). Once those deadlines have passed, the penalty becomes final and the only option left is to go to court (contentious-administrative proceedings).
Can I drive in Spain with my home country's license?
Yes, for the first six months after you establish your normal residence in Spain. After that, your license is no longer valid for driving here: you'll need to exchange it for a Spanish one if your country has an exchange agreement with Spain, or get a new one if it doesn't.
How do I exchange my foreign driver's license?
You book an appointment at the Provincial Traffic Office (Jefatura Provincial de Tráfico) and provide your original license along with documents proving your legal residence. Colombia has had a license exchange agreement with Spain since 2003, as have Argentina, Bolivia, Brazil, Chile, Ecuador and Peru. For cars and motorcycles the exchange is direct, with no test; for trucks or buses you'll need to pass tests. The fee for a direct exchange is 28,87 €. Your license must have been obtained before you became a legal resident in Spain.
I have outstanding fines and I'm applying for residence. Does it affect me?
A traffic fine is an administrative penalty, not a criminal record, and what arraigo (residence based on ties to Spain) requires is having no criminal record. Outstanding fines alone don't block your application. Road safety offenses are a different matter (driving without a license, over the criminal blood-alcohol limit or recklessly): those are criminal and can affect the decision.
